Terms and Conditions

1. Scope

The following Terms and Conditions (T&Cs) apply to all orders placed via our online shop by consumers and businesses.

A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession. A business is a natural or legal person or a legally responsible partnership that acts in the course of their trade or independent professional activity when concluding a legal transaction.

For businesses, the following applies: If the business uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they shall only become part of the contract if we have expressly agreed to them.

2. Contractual Partner, Conclusion of Contract

The purchase contract is concluded with Marek Drozdowski.

The presentation of products in the online shop does not constitute a legally binding offer but rather a non-binding online catalog. You can place products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided in the ordering process. By clicking the order button, you submit a binding order for the items in your cart. Confirmation of receipt of your order will be sent via email immediately after the order is placed.

When the contract is concluded with us depends on the payment method you choose:

Prepayment
We accept your order by sending a separate email with an acceptance declaration within two days, which also includes our bank details.

PayPal
During the order process, you will be redirected to the website of the online payment provider PayPal. There, you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the shop, we request PayPal to initiate the payment transaction, which constitutes acceptance of your offer.

Cash on Collection
You pay the invoice amount in cash upon collection.

3. Contract Language, Storage of Contract Text

The languages available for concluding the contract are German and English.

We do not store the text of the contract.

4. Delivery Conditions

In addition to the stated product prices, shipping costs may apply. You can find more details about shipping costs with each offer.

You can also collect your order at Marek Drozdowski, Arnsdorfer Str 15e, 02692 Obergurig, Germany, during the following business hours: 08:00 – 16:00.

We do not deliver to parcel lockers.

5. Payment

The following payment methods are generally available in our shop:

Prepayment
When choosing prepayment, we will send you our bank details in a separate email and deliver the goods after receiving payment.

PayPal
During the ordering process, you will be redirected to PayPal. To pay the invoice amount via PayPal, you must be registered with them or register first, log in with your access data, and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction, which is then carried out automatically by PayPal. Further instructions will be provided during the order process.

Cash on Collection
You pay the invoice amount in cash upon collection.

6. Right of Withdrawal

Consumers are entitled to the statutory right of withdrawal as described in the cancellation policy. Businesses are not granted a voluntary right of withdrawal.

7. Retention of Title

The goods remain our property until full payment is received.
For businesses, the following applies additionally: We retain ownership of the goods until all claims from an ongoing business relationship are fully settled. You may resell the goods subject to retention of title in the ordinary course of business; all claims resulting from such resale are assigned to us in advance – regardless of any combination or mixing of the goods with a new item – in the amount of the invoice, and we accept this assignment. You remain authorized to collect the claims, but we may also collect the claims ourselves if you fail to meet your payment obligations.

8. Transport Damage

For consumers: If goods are delivered with obvious transport damage, please report such defects to the delivery personnel as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, particularly your warranty rights. However, you help us assert our own claims against the carrier or transport insurer.

9. Warranty and Guarantees

The statutory warranty law applies. Information on any additional guarantees that may apply and their exact terms can be found with the respective product and on special information pages in the online shop.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are not obligated or willing to participate in a dispute resolution procedure before a consumer arbitration board.

11. Final Provisions

If you are a business, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
